HOUSTON – Hicks Thomas lawyer Stewart Hoffer, who advise small businesses and major companies, wrote a commentary offering tips to employers that were published recently by Texas Lawyer.
Headlined “How to Avoid Top 5 Mistakes Employers Make,” the article addresses everything from best hiring practices to picking the right litigation strategy when an employee files suit.
Among one of the many interesting insights from the article is this:
“Defense lawyers often encounter evidence that the employer had multiple, valid reasons for discharging/disciplining an employee before the incident giving rise to the lawsuit, but the employer did not take action in an effort to ‘be nice.’ Bad idea. Juries expect employers to discipline employees who engage in misconduct and to keep contemporaneous records of those activities.”
Mr. Hoffer, a Hicks Thomas partner, has represented companies in trials across the country, achieving successful results in a variety of cases including noncompete and trade secrets disputes and commercial litigation.
